Civil Matters
Small Claims
Small claims actions are limited to disputes involving $6,500 or less. Parties must represent themselves—attorneys are not allowed unless they are a direct party.
Businesses may be represented by a knowledgeable full-time employee. Forms are available at both court locations or online.
Filing Fees
- Up to $600: $30 + service fee
- $601–$1,750: $50 + service fee
- $1,751–$6,500: $70 + service fee
Serving the Complaint
- Certified mail: $13.50 per defendant (paid with filing fee; may increase with postage costs).
- Sheriff or process server: You will be billed directly.
Judgments
If you win a judgment, and the opposing party pays, you must notify the Court in writing once payment has been made in full.
Landlord / Tenant
The Court provides Notice to Quit forms for:
- Non-payment of rent (7-day notice)
- Termination of tenancy (30-day notice)
- Health hazard/injury to premises (7-day notice)

Summons forms are available upon request, but you must prepare your own complaint to accompany them.

Court Services
Marriage Ceremonies
Civil marriage ceremonies are offered at the Courthouse on weekdays from 9:00 a.m. to 4:00 p.m. Both the District Court Magistrates and the Judge perform ceremonies.
Requirements:
- A valid Michigan marriage license
- Two adult witnesses
- $10 fee (paid at the time of the ceremony)

Probation Services
The probation officer for Alger County is Scott Smith, (906) 387-3879.
Probation services include:
- Oversight of probation clients
- Monitoring education, counseling, and rehabilitation programs
- Coordination of substance abuse or domestic violence services
- Collection of fines, costs, and restitution
Criminal & Traffic Matters
Traffic Violations
If you receive a civil infraction ticket, you may:
- Admit responsibility
- Admit with explanation
- Deny responsibility and request a hearing
Explanations can be given in person to the Magistrate or submitted in writing. The Magistrate will provide a response.
Payments
- Methods: money order, check, credit card (follow outlined process), or cash (accepted at both court offices).
- Include your ticket and sign the back indicating admission of responsibility (or guilty plea for minor misdemeanors).
- Payments are due within 10 days, unless you make arrangements with the Court.
Failure to respond will result in judgment entered against you, followed by statutory notices and license suspension.
If your license is suspended for nonpayment or failure to appear, you must resolve the judgment with money order or cash only.
Bail and Bond
Bail money deposited with the Court ensures the defendant’s appearance for all required proceedings until the case concludes.
Payment
- Must be posted in cash or by credit card (no checks).
Use of Bond Money
- Posting for someone else: You must state whether bond funds may be applied to fines/costs if convicted.
- Posting for yourself: Funds are automatically applied after sentencing.
Refunds
- Issued after sentencing or acquittal.
- Bring bond receipt and photo ID to the Clerk’s Office.
- For 10% bonds, the Court keeps 10% (e.g., $500 bond → $45 retained).
Forfeiture and Revocation
- If the defendant fails to appear, bond is forfeited after notice.
- To revoke bond, petition the Court; funds are returned once the defendant is in custody.
Misdemeanor Offenses
Many minor misdemeanors and most non-traffic infractions may be handled by the Magistrate.
- Walk-in arraignments are allowed between 9:00 a.m. and 4:00 p.m.
- If you were not given a date and time for arraignment, call the Court.
- Court business hours: 8:00 a.m.–4:00 p.m. (closed noon–1:00 p.m.).
